　　律师称，从前有的案子可以上诉，但今年被拒绝的案子几乎都毫无理由，退回的案子许多是移民局认为“所申请的职位不是公司必要的”，这让案子很难上诉，无法去反驳移民局。按照联邦法律，移民官有自主裁决权，许多案子上诉也没有好理由。这两年H-1B补件比例比较高，尤其是学商和学文的。
　　华通夏令营老师指出，移民官要从几个方面审核申请，其中一个就是要问这个公司需不需要你的专长。最近几年商科毕业生比较多，这种商科专业可以在很多地方工作，他们可以在各种行业工作，有点像“万金油”，所以移民局会有疑问，这样审批难度就会加大。
　　律师还举例说，从前有很多申请市场调查的案子都被通过了，但是现在这种案子特别容易被要求补件，如移民官会问申请人的公司有做了哪些市场调查服务，并要公司出示市场调查成员的具体分工细节。
