一、进行涉外临时住宿登记管理的主要法律依据
the main law guidelines governing aliens'temporary accommodation registration
《中华人民共和国外国人入境出境管理法实施细则》第十七条规定“外国人在中国境内临时住宿，应当依照规定，办理住宿登记”。
the aliens who lodge in china temporarily should apply for temporary accommodation registration in accordance with provisions of article 17 of 《rules governing the implementation of the law of the people's republic of china on the entry and exit of aliens》.
《中华人民共和国外国人入境出境管理法实施细则》第二十九条规定：“外国人在宾馆、饭店、旅店、招待所、学校等企业、事业单位或者机关、团体及其他中国机构内住宿，应当出示有效护照或者居留证件，并填写临时住宿登记表。在非开放地区住宿还要出示旅行证。”
article 29  for lodging at guesthouse, hotel, in hostel, school or other enterprises and institution or at government organs or other chinese organizations, aliens shall present valid passports or residence certificates and fill in registration forms of temporary accommodation. they shall present travel permits when seeking accommodation in areas not open to aliens.
《中华人民共和国公民出境入境管理法实施细则》第十三条规定：“定居国外的中国公民短期回国，要按照户口管理规定，办理暂住登记。在宾馆、饭店、旅店、招待所、学校等企业、事业单位或团体及其他机构住宿的，应当填写临时住宿登记表。”
《旅馆业治安管理办法》第六条规定：“旅馆接待旅客必须登记，登记时应当查验旅客身份证件，按规定的项目如实登记。接待境外旅客住宿还应在二十四小时内向当地公安机关报送住宿登记表”。
《中国公民往来台湾地区管理办法》第十八条:“台湾居民短期来大陆，应当按照户口管理规定，办理暂住登记。在宾馆、饭店、招待所、旅店、学校等企业事业单位或者机关、团体和其他机构内住宿的，应当填写临时住宿登记表，住在亲友家的，由本人或者亲友在二十四小时(农村七十二小时)内到当地公安派出所或者户籍办公室办理暂住登记手续。”
《中国公民因私事往来香港地区或者澳门地区的暂行管理办法》第十七条：“港澳同胞短期来内地，要按照户口管理规定，办理暂住登记。在宾馆、饭店、旅店、招待所、学校等企业、事业单位或者机关、团体及其他机构内住宿的，应当填写临时住宿登记表，住在亲友家的，由本人或者亲友在二十四小时内(农村可在七十二小时内)到住地公安派出所或者户籍办公室办理暂住登记。”　
二、违反临时住宿登记管理的处罚规定。
《中华人民共和国外国人入境出境管理法》第二十九条规定：“对违反本法规定，非法入境、出境的，在中国境内非法居留或者停留的，未持有效旅行证件前往不对外国人开放的地区旅行的，伪造、涂改、冒用、转让入境、出境证件的，县级以上公安机关可以处以警告、罚款或者十日以下的拘留处罚，情节严重，构成犯罪的，依法追究刑事责任。”
if a person, in violation of the provisions of this law, enters or leaves china illegally, establishes illegal residence or illegal stay in china, travels to places closed to aliens without a valid travel permit, forges or alters an entry or exit certificate, uses another person's certificate as his own or transfers his certificate to others, he may be penalized by a public security organ at or above the county level with a warning, a fine or detention for no more than ten days. if the circumstances of the case are serious enough to constitute a crime, criminal responsibility shall be investigated in accordance with the law.
第三十条规定“有本法第二十九条所列行为情节严重的，公安部可以处以限期出境或者驱逐出境处罚”。
article 27 provides “in cases where a person commits any of the acts stated in article 29 of the law, if the circumstances are serious, the ministry of public security may impose a penalty by ordering him to leave the country within a certain time or may expel him from the country.
《中华人民共和国外国人入境出境管理法实施细则》第四十五条规定：“对违反本实施细则第四章规定，不办理住宿登记或者不向公安机关申报住宿登记或者留宿来持有有效证件外国人的责任者，可以处警告，或者处五十元以上、五百元以下的罚款。
article 45 provides“whoever is held responsible for failing to register accommodation or report such registration to the public security organ , or accommodate aliens without valid certificates in contravention of the provisions of chapter Ⅳ of the present rules may be served a warning or fined from 50 to 500 rmb.
《中国公民往来台湾地区管理办法》第三十七条规定：“违反本办法第十八条、第十九条的规定，不办理暂住登记或者暂住证的，处以警告或者一百元以上、五百元以下的罚款。”
《旅店业治安管理办法》第十六条规定：“旅馆工作人员违反本办法第九条规定的，公安机关可以酌情给予警告或者处以二百元以下罚款；情节严重构成犯罪的，依法追究刑事责任。旅馆负责人参与违法犯罪活动，其所经营的旅馆已成为犯罪活动场所的，公安机关除依法追究其责任外，对该旅馆还应当会同工商行政管理部门依法处理。
三、办理临时住宿登记的对象和范围
根据有关法规，凡离开本人登记的住所在我国临时住宿的外国人、华侨、台港澳同胞，除特殊规定外，都必须进行临进住宿登记，具体有下列几类：
the objects and sphere of applying for temporary accommodation registration. according to relevant law and regulations, the aliens who leave their own registration place but lodge temporarily in our country must apply for the temporary accommodation registration except the special provisions ,the special conditions is as follows:
1、临时来华外国人持l、f、g、c、j-2字头签证的外国人在签证的有效期内在中国停留，必须按规定进行临时住宿登记。
the aliens who hold valid visas l、f、g、c、j-2 and stay in china apply for temporary registration in accordance with provisions.
2、在我国定居或长住的外国人、临时外出并在异地住宿时，必须按规定办理住宿登记。
the aliens who reside in china or stay in china for a long-term period must apply for accommodation registration in accordance with provisions when they go to the other place and lodge there temporarily.
3、享有外交特权与豁免的外国人，外出旅行时在驻华外交代表机构，领事机构以外临时住宿的，也要按规定办理住宿登记。
the aliens who have the diplomatic privilege or exception must also apply for accommodation registration in accordance with provisions when they travel and lodge in place temporarily other than diplomatic organization or consular organization in china.
4、华侨、港澳台同胞回大陆，无论短期停留还是长住，都要按规定办理暂住登记。
临时住宿登记的范围，包括在固定性建筑物中临时住宿和在移动性工具中临时住宿。固定性建筑是指：宾馆、饭店、机关、团体、企业、学校、居民住宅等。移动性工具是指：船舶、汽车、帐篷、活动房屋等。只在某地停留不住宿的，不进行临时住宿登记。
the sphere of temporary accommodation registration includes:
the temporary accommodation in firm building and the movable transport tool, the firm building refers to :hotel restaurant administration corporate enterprise school residence house and so on. the movable transport refers: ship car tent movable house and so on. the aliens who just stay in one place no more than a day need not apply for the temporary registration.
外国人每变换一个住宿处所，应当进行一次临时住宿登记。
the aliens who change one accommodation place every time should apply for one temporary accommodation registration.
四、住宿登记
accommodation registration
1、外国人来奎文区涉外宾馆住宿，要出示有效护照或居留证件，由宾馆服务人员指导详细填写住宿登记表。
the aliens must present valid passport or residence certificate when they come to lodge in hotel of kuiwen district and they can be directed to fiu in the registration form by the hotel's waiters.
2、奎文区内企业、事业单位或者机关团体及其它机构，经公安机关批准后，可接待来本单位联系业务或进行工作的外国人住宿，并于当日由本单位陪同本人，持有效护照到公安机关办理暂住登记。
the enterprise、administration or corporate and the other organizations can accept the aliens who come to do business or work to lodge there when they are approved by the police administration and the unit should accompany with the aliens who carry the valid passport to apply for temporary registration in the local police station within the present day.
3、外国人在奎文区居民家中住宿的，须于抵达后二十四小时内由留宿人或本人持住宿人的护照，证件和留宿人的户口簿到当地公安派出所申报，填写临时住宿登记表。
when the aliens lodge in the resident's home of kuiwei district, the lodger or host must carry the lodger's valid certificate to local police station to apply and fill in the temporary accommodation registration form, passport, certificate and the host's residence booklet within 24 hours of lodger's arrival.
4、长期在中国其它地区留居的外国人来奎文区住宿，应按照以上三条的要求办理申报住宿登记。
the aliens who live in the other places for a long time come to lodge in kuiwen district should apply for the registration of accommodation in accordance with the above three requirements.
5、华侨、港澳居民、台湾居民短期来奎文区，要按照法律规定办理暂住登记。
(1)在奎文区涉外宾馆住宿要出示有效入、出境证件，由宾馆服务人员指导详细填写住宿登记表。
(2)在具备涉外接待条件的企业、事业或者机关、团体及其它机构住宿，须干当日由单位陪同本人持有效护照或入境证件到公安机关办理暂住登记。
(3)在居民家中住宿的，须于抵达后二十四小时内，由留宿人或本人持住宿人的出入境有效证件和留宿人户口簿到当地公安派出所申报，填写临时住宿登记表。
